Hibiscus BeautyAmbassador Terms and Conditions
These terms and conditions is a legal agreement between Hibiscus Beauty and you ("ambassador"). By signing up to be an ambassador in the Hibiscus Beauty Ambassador Program ("program") you agree to be bound by the following terms and conditions. Please ensure that you read them carefully before signing up.
Agreement - the contents of the contract between Hibiscus Beauty and the Ambassador in respect to the Program Program - The ambassador program as set out on the Site and is governed by this Agreement Ambassador - Party who agrees to take part in the Program Link - a HTML link provided to the Ambassador to link the Ambassador's website to the Site Site - www.hibiscusbeauty.page website
1. The Agreement
1.1. An Ambassador must provide full legal name, valid address, e-mail address and any other information requested in order to create an Ambassador account.
1.2 An Ambassador must have a valid PayPal address to receive commission payments and include this on their profile during registration.
1.2. Hibiscus Beauty reserves the right to update and change the Terms from time to time without notice.
1.3. Any modifications or changes to the Program shall be subject to these terms.
1.4. You may not use the Program for any illegal or unauthorized purpose.
Violation of these terms and conditions may result in suspension of your rights to be an Ambassador and result in lost commissions and/or removal from the Program.
2. Modification of Hibiscus BeautyAmbassadorprogram terms and conditions
Hibiscus Beautyreserves the right to modify or otherwise change the terms of the agreement at any time. In the case of any modifications of the terms and conditions in this agreement, it is up to the ambassador to stay updated on the terms of this agreement as Hibiscus Beautymay change terms without notice from time to time. If the ambassador doesn't accept any modification, the ambassadors option is to end the agreement.
3. Ambassador account
In order to enter the Hibiscus Beauty Ambassador Network (Provided by Secomap), the ambassador needs to create a log-in and password. From this account the ambassador is able to track and view sales, and receive commission payments.
4. Legitimate methods of advertising
4.1. Ambassadors are permitted to use links, discount codes, any related banners, or text advertisements provided by Hibiscus Beauty Ambassador program.
4.2. Ambassadors are not permitted to promote any non-ambassador program related materials, such as coupon codes provided in customer newsletters, codes provided to other ambassadors, any promotional codes, or codes received from any source other than directly from the Hibiscus Beauty ambassador program.
4.3. The promotion should include the offer, discount code, link provided by Hibiscus Beauty ambassador program and expiration date.
4.4. Ambassadors must remove invalid codes and banners.
4.5. Ambassador coupon codes and links are not to be promoted on third party websites such as coupon databases.
4.6. Ambassadors are permitted to promote their coupon code and link on their personal social media platforms only and must not share this information on any Hibiscus Beauty social pages.
4.7. Please note it is strictly forbidden to use Hibiscus Beauty’s trademark and your ambassador link on any paid advertising channels.
4.8. Any sales that have been generated through improper promotion, will result in loss of commission.
4.9. Ambassadors may not advertise any other BEAUTY SUPPLY STORE whilst enrolled in the Hibiscus Beauty ambassador program. Should the ambassador wish to advertise another BEAUTY SUPPLY STORE, the ambassador is responsible for ending the partnership with Hibiscus Beauty by sending an e-mail. Should Hibiscus Beauty find that the ambassador is promoting another BEAUTY SUPPLY STOREduring the Ambassador term with Hibiscus Beauty without receiving prior notification by e-mail, this may result in suspension of your rights to be an Ambassador and result in lost commissions and/or removal from the Program.
4.10. Hibiscus Beauty reserves the right to take legal action against Ambassador that commits fraud.
4.11. Ambassador codes will be changed on a frequent basis and ambassadors will be contacted with their new code. All old codes must be removed and replaced with the new discount code.
5. Copyrighted material
Ambassador is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right or any other applicable law. Hibiscus Beauty will not be responsible if an ambassador uses another party's copyrighted material in violation of law.
6.1. Ambassadors receive a commission for sending authorized sales via links provided by Hibiscus Beauty Ambassador Program. The customer must make a purchase by clicking the link on ambassador's website within 30 days of the initial click-through.
6.2. The commission is based on product that is sold. Payments are made once an ambassador reaches minimum of 5,000 of commissions required for a payout.
6.3. Payout rates may be changed and they can be viewed by logging into ambassador's account.
6.4 The commission structure does not apply to any of the following Hibiscus Beauty Products:Hibiscus Beautyeyelashes and other accessories and hair tools. No commission payment will be provided for any orders including these products only.
6.5. It is ambassadors responsibility to determine if the payout for the link provided has been discontinued.
6.6. The commission is paid only on coupons that can be tracked and reported by theHibiscus Beauty ambassador program systems. In order for systems to track the referral, the customer must have cookies enabled.
6.7. Refunded payments do not qualify for commission fee.
6.8 Payments may be revoked in the instance that a code is leaked on third party websites. It is the ambassador's responsibility to ensure their code is not leaked.
7. Hibiscus Beauty Obligations
Hibiscus Beauty agrees to undertake the following obligations:
7.1. Providing the ambassador with promotional material, such as links, coupon codes, banners and any other graphic materials.
7.2. Processing all orders for Hibiscus Beauty products placed by following the ambassador's link.
7.3. Tracking the amount of sales generated through the ambassador’s’ link and all social media content via tags and mentions
7.4. Payment processing, cancellations, returns and other related customer service for Hibiscus Beauty for the purpose of business.
7.5 Providing an order worth 5,000 of Hibiscus Beauty products to ambassadors (2) times per year or every (6) months.
8. Ambassador Obligations
8.1 Ambassadors are required to post on their social media platforms on a monthly basis one piece of unique, original content
8.2 One piece of content can include the following items: IG feed posts, IGTV, Youtube Video (review, get ready with me glam/date night, hair tutorials), blog post (review, hair tutorial). Additional content may include IG stories (4+ frames)
8.3 Instagram content must tag @hibiscusbeautyjp on the photo and in the caption, plus the hashtag #hibiscusbae, in order for Hibiscus Beauty to track all content created.Youtube and blog content must link back to the Hibiscus Beauty website.
8.4 All content must be sent directly to the influencer manager at the end of the month for accounting purposes and re-sharing opportunities
8.5 Ambassador must be following @hibiscusbeautyjp
8.6 Failure to follow ambassador obligations may result in ambassador content being overlooked and potential removal from the program.
8.7 If ambassadors are unable to complete content, they may contact the Hibiscus Beauty ambassador manager for assistance and provide reasoning.
8.8 Ambassador removal will take place if ambassadors fail to oblige with content requirements set forth in this agreement.
9. The License
9.1. Hibiscus Beauty grants to the Ambassador a non-exclusive, non-transferable, revocable right to access Hibiscus Beauty site though the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorized by Hibiscus Beauty.
9.2 Hibiscus Beauty can use content created on social media platforms, website, ads for Hibiscus Beauty by ambassadors (ambassador will be credited).
9.3. Ambassadors cannot modify or change any materials provided by Hibiscus Beauty in any way WITHOUT PERMISSON.
9.4. Both parties agrees not to use other's materials in any manner that is misleading, disparaging or in any way portrays the party in a negative light.
9.5. Any inappropriate use of the promotional material may be cause for immediate termination of the agreement.
Hibiscus Beauty will not be liable to the Ambassador for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the Ambassador tracking service or other consequential loss of whether arising from neglect or breach of contract.
The term of the agreement starts upon Hibiscus Beauty ambassador program acceptance of ambassador's application and can be terminated by either party. Affiliation can be ended with or without cause at any time, by giving the other party notice of termination in the form of e-mail. Upon the termination of the agreement, the ambassador will remove all links to Hibiscus Beauty website, as well as all banners and graphic images provided under the Program.
Personal Information Controller
Any personal information provided to or gathered by Secomapp under this Privacy Notice will be stored and controlled by Secomapp (the data controller).
Information collected from Merchants
When Hibiscus Beautyuses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.
Information collected from Affiliates
When an ambassador signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process-specific activities within the app and contact affiliate if needed.
Information collected from Customers when visiting the Hibiscus Beauty website
In order to track referral order, when customers visit the Hibiscus Beauty website and make a purchase, Secomapp system will collect information of order such as total order, order items, order ID, etc.
“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.
Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.
We may also disclose your personal information to any third party with your prior consent.
Use of Secomapp app by Children
Secomapp is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.
Secomapp understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through firstname.lastname@example.org. We may require that you provide us with acceptable verification of your identity before providing access to such information.
If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
